Reusing Base Content In A Payware Package - Allowed Or Not?

I am a 3rd party developer working on and publishing freeware modifications to the MSFS 2024 base content P-51 Mustang and T-6 Texan. Several users have asked if it is possible to bring these mods to the marketplace.

I understand that writing improved XML behaviors, revised CFGs, and even modification to 3D assets are allowed IF those modifications remain as “widely available freeware”.

What I am unsure of is the ability to modify/enhance and redistribute the 3D model as I had identified and planned several modifications/feature improvements which would be part of a paid improvement/overhaul package.

It seems based on the Game Content Usage Rules we are NOT allowed to modify and redistribute base content for “compensation”, and as such my plans for a payware mod/overhaul would not be permitted under the current rules. The only way forward would then be:

A: Not modifying 3D assets and limiting improvements to XML/CFG/Textures

B: Commissioning a scratch-built model, and thus creating an entirely new product from scratch.

Is that correct?

Have you signed a marketplace agreement? The most recent one is fairly clear on what is and isn’t allowed.

Reusing the stock aircraft models would fall under not allowed afaik, unless you are aliasing to them. So you couldn’t include the model in your package.

So yes, a new model would be needed if you are going to make changes to that.

I have not seen the marketplace agreement, no. The plan was to collaborate with a developer who is already established on marketplace for this project. Is there a public link to that or should I query my contact to review it?
